  • 1.1. Document content. This privacy policy describes how we process the personal data of website visitors, online store customers, and other individuals. All described personal data processing activities are carried out in the role of data controller by MOBIOLA WORLDWIDE s.r.o., with registered office at Českobratrská 692/15, 70200 Ostrava, Company ID No. 06490557, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 72109, VAT ID CZ06490557 (hereinafter referred to as “we”). This means that we determine the purposes for which personal data is collected, decide on the means of processing, and are responsible for proper execution.
  • 1.3. Scope of personal data processing. We process the following categories of personal data:
    • 1.3.1. identification data (e.g. first and last name, Company ID and VAT ID for entrepreneurs),
    • 1.3.2. contact data (e.g. address, email address, and phone number),
    • 1.3.3. data on orders and transactions (e.g. ordered goods and services, payment and delivery methods, other data related to the order),
    • 1.3.4. data on mutual communication (e.g. content and data related to communication between you and us),
    • 1.3.5. registration and settings data (e.g. information on your user account and service settings),
    • 1.3.6. data on the use of our website (e.g. IP address, device information, cookies, behavior on the website).

Why and How We Process Your Personal Data

  • 2.1. Website operation. To ensure our website functions correctly, we process your data based on our legitimate interest in providing our services online.
  • 2.2. User account. We process your data based on a contract when managing user accounts in our e-shop.

  • 2.13. Data retention period. We retain personal data only for the time necessary. After the purpose ends, we delete them without delay. Generally, we store them for 3 years after contract termination + 1 year for potential claims. Specifically:
    • 2.13.1. We store account data until the account is deleted.
    • 2.13.2. For legal disputes, we keep the data during the case and for the limitation period afterward.
    • 2.13.3. For marketing messages, we store the data until you unsubscribe.
    • 2.13.4. Data based on consent is stored until the consent is revoked.
    • 2.13.5. Data for legal obligations is processed for the period required by law.

Why Your Personal Data Is Shared

  • 3.1. Data Processors. We also use third-party services acting as data processors, who process personal data only based on our instructions. These mainly include:
    • 3.1.1. IT service providers and other technology vendors,
    • 3.1.2. Providers of analytics and marketing tools,
    • 3.1.3. Providers of communication tools.
  • 3.2. Data Controllers. We may also share your personal data with other entities acting as independent controllers:
    • 3.2.1. Our suppliers involved in fulfilling the contract, particularly carriers and payment system operators,
    • 3.2.2. Operators of advertising systems and social networks.
  • 3.3. Transfers Outside the EU. In some cases, your personal data may be transferred outside the European Economic Area, either based on an adequacy decision under Article 45 of the GDPR, appropriate safeguards under Article 46, or exemptions under Article 49.

Your Rights

  • 4.1. Data Subject Rights. In relation to your personal data, you have the right to:
    • 4.1.1. Request the correction of inaccurate or outdated personal data. If you find that the personal data we process is incorrect or incomplete, you have the right for us to correct or supplement it without undue delay,
    • 4.1.2. Request confirmation of whether your data is being processed and, if so, information about such processing as specified in Article 15 of the GDPR, as well as a copy of the data being processed (we may charge a fee for additional copies to cover necessary costs),
    • 4.1.3. In certain cases, request the deletion of your personal data. We will delete your data without undue delay if we no longer need it for the purposes it was collected, or if you exercise your right to object and we find no overriding legitimate interest, or if the processing is found to be unlawful. This right does not apply if the processing is necessary for legal obligations, archiving, research or statistical purposes, or for the establishment, exercise or defense of legal claims.
    • 4.1.4. Request the restriction of processing. In specific cases, you can ask for your data to be flagged so that it is not subject to further processing — not permanently (as with deletion), but temporarily. We must restrict processing, for example, when you dispute the accuracy of the data, or when we are processing without a sufficient legal basis, or when we no longer need the data, but you require it to establish, exercise, or defend legal claims, or if you object and we are verifying whether the objection is justified.
    • 4.1.5. Request data portability in cases where data is processed based on your consent or a contract,
    • 4.1.6. Object to processing based on our legitimate interest. We will stop processing your data unless we demonstrate compelling legitimate grounds. Objections to marketing activities will always be honored.
    • 4.1.7. Withdraw your consent at any time or express your disagreement with processing for marketing purposes, unless the processing is based on a legal obligation or our legitimate interest.
